Freedom of Information Appeal of Freedom of Information Act Requests

Dear Sir or Madam:
I represent the American Friends Service Committee, Northeast Ohio Office
("AFSC"), and its Director, Gregory D. Coleridge (the "Requesters"), in their appeal of the
responses of the U.S. Environmental Protection Agency Region 5 ("Region 5") and some of its
sub-units to the above-referenced Freedom of Information Act ("FOIA") requests. This letter
constitutes their appeal.
This appeal concerns a series of related FOIA requests seeking information
regarding the presence of radioactive waste at the Industrial Excess Landfill Superfimd Site
("IEL") in Uniontown, Ohio. With respect to two of these requests, Region 5 is apparently
withholding documents, having failed to even reply to one request. With respect to three of these
requests, Region 5 failed to conduct adequate searches for responsive documents. Serious
underlying issues concerning the health and safety of the community surrounding the EEL
underscore the gravity of this appeal.
