Now comes Plaintiff Gregory D. Coleridge, by and through his attorney Warner
Mendenhall, who hereby submits a proposed memorandum and order pursuant to this
Court’s instructions of May 19, 2003.
In pursuit of records under the Freedom of Information Act, 5 U.S.C. § 552
("FOIA"), Plaintiff has consistently sought information regarding documentation of the
“deposit, presence and/or impact of radioactive materials at the Industrial Excess Landfill
(IEL) site in Uniontown, Ohio” from all Defendants. Pl. Ex.s 5, 11, 12, 15, 16, 17, 18,
27, 33, 40, 43, 51. This Court finds that the Defendant Agencies failed to respond to
requests for information, failed to respond to appeals, failed to conduct adequate
searches, and improperly withheld information under FOIA as follows:
